Terms:

Accounts are done strictly on a prepayment or C.O.D. basis, unless prior approval has been obtained. Credit can be arranged by submitting a credit application for processing. Any application not completed and signed will not be considered for approval. Please allow a minimum of 30 days for credit approval. For customers with approved credit, invoices are due on a 30-day net basis. We reserve the right to terminate such terms pending nonpayment of account. This includes the right to cancel open orders on any past due accounts. Past due accounts will be subject to service charges assessed at the rate of 1.5% per month on any balance over 30 days. Customers agree to pay any and all collection expenses. This includes attorney fees and court costs should they be necessary to effect the collection of your account. A fee of $35.00 will be charged for all returned checks. For your convenience we accept MasterCard and Visa.

Conditions:

All plant material is inspected prior to shipment and is in good condition when accepted by the respective transportation company. All plant material should be inspected upon arrival. Any problems with the quality, quantity, or condition of the plant material must be reported. Claims must be made within 48 hours by fax, telephone or email after receipt of goods. A digital image of product is required on all claims. AG3 reserves the right to have plant material returned to us prior to honoring any claims. If your shipment is damaged during transit, then you need to take pictures and report it as soon as possible to the carrier. AG3 will not be responsible for damage to plant material incurred during transit, including damaged boxes, smashed plantlets or plantlets out of cells due to rough transit. AG3 reserves the right to have plants that are associated with a claim returned.

Prices:

List prices are in U.S. Dollars, F.O.B. Eustis, Florida and for the wholesale trade only. Prices are effective July 4, 2022 and are subject to change without notice. Prices stated do not include shipping and handling charges. Boxing charge for up to 3 trays is $6.25 and winter pack is $9.70. Boxing charge for 4 to 6 trays is $9.70 and winter packing is $13.00. There is a minimum order of 1 cell pack tray.

No Partial trays! We ship to the U.S. and Canada only. There is an international handling fee of $50.00 per order. Phytosanitary inspection fees are $65.00 per order and are subject to change without notice. Phytosanitary inspection fees and other inspection fees required by US states are the responsibility of the customer and subject to change without notice.

Domestic Shipping:

Shipping expenses incurred by LTL carrier, UPS, Federal Express, Air Freight or by any other means is the sole responsibility of the customer. If an order is required to ship by means of Air Freight, AG3 must be given the airline and airport code. In the event that misinformation is given to the wrong destination airport, additional freight charges may be incurred and added to the invoice. The customer must provide their desired means on freight transportation. Due to our experience with 'Ground' shipments, AG3 can not accept claims for plants shipped by this method.

International Shipping:

We ship to the U.S. and Canada only. All international shipments are the responsibility of the customer. We will not accept any claims for international shipments.

Phytosanitary Inspection fees are $65.00 per order. An additional U.S.D.A. fee of $6.00 is charged for all shipments requiring a Federal Phyto rather than a State Phyto. CITES are $66.00 on orders less than $1,250.00 and $111.00 on orders $1,250.00 and over. International handling fee is $50.00 per shipment. Special Chemical application fees are $35.00 if required by importing country. Phytosanitary inspection fees and other inspection fees required by US states are the responsibility of the customer. These and any other additional agricultural inspections and fees that are necessary will be charged to customer and are subject to change without notice.

Contract propagation is available. Please contact us for further information on this service. Patented or trademarked items may be subject to royalty payments or restricted to licensed growers depending upon agreements with patent or trademark owners.

Guarantee & Limited Liability:

At AG3 we strive to produce quality material that is true-to-type. In the event that any of our plant products (stock) is proven to be untrue to its name as labeled for slow growth, non-producing plants, off types (mutations) our liability is exclusively limited to replacing the material free of charge or refunding the purchase price. AG3, Inc will not be liable for consequential damages or for any amount more than the actual purchase price for the plant material. No warranties, either expressed or modified, including the warranties of merchantability and fitness for a particular purpose, are extended.
